Terms of Service

Please read these terms carefully before using Envision Talent Solutions.

1. Acceptance of Terms

By accessing or using the Envision Talent Solutions website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.


Envision Talent Solutions ("Envision," "we," "us," or "our") reserves the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

Envision Talent Solutions provides a Google Sheets-based Applicant Tracking System (ATS) template and related recruiting and consulting services. Our template includes:

  • Tier 1 (Free): A downloadable Google Sheets template with automated candidate tracking, workflow management, and documentation

  • Tier 2 (Paid): Enhanced automation features, advanced reporting, and premium support (when available)

  • Tier 3 (Enterprise): Full-service recruiting support, custom features, and dedicated account management (when available)

3. User Accounts and Registration

To access certain features of the Service, you may be required to provide your email address or other contact information. You agree to:

  • Provide accurate, current, and complete information

  • Maintain and promptly update your information to keep it accurate

  • Maintain the security of any passwords or access credentials

  • Accept all responsibility for any activities that occur under your account

4. Use of the Template

The template is provided free of charge for your use. You may modify, customize, and use it for your business needs. We encourage learning from and improving upon the template.


You are responsible for maintaining backups of your data and ensuring your use complies with applicable laws.

5. User Data and Privacy

The template operates within your own Google Workspace environment. Envision does not have access to, collect, or store any candidate data or information you enter into the template. All data remains within your control in your Google Sheets file.

Important: You are solely responsible for ensuring your use of the template complies with all applicable data protection laws, including but not limited to GDPR, CCPA, and other privacy regulations. You must obtain appropriate consent from candidates before collecting and storing their personal information.

6. User Responsibilities

You are responsible for:

  • Maintaining adequate backups of your data stored in the template

  • Ensuring compliance with all applicable employment laws and regulations in your jurisdiction

  • Obtaining necessary consents from candidates for data collection and storage

  • Implementing appropriate security measures for sensitive candidate information

  • Your own use of Google Workspace and compliance with Google's Terms of Service

7. Third-Party Services

The template integrates with and operates within Google Workspace (Google Sheets, Google Forms, Google Drive). Your use of Google services is governed by Google's Terms of Service and Privacy Policy. Envision is not responsible for any changes, interruptions, or issues with Google services that may affect the template's functionality.

8. Fees and Payment

9.1 Free Template (Tier 1)
The basic template is provided free of charge. Envision reserves the right to modify or discontinue the free offering at any time.

9.2 Paid Services (Tiers 2 & 3)
If you subscribe to paid services when available, you agree to pay all fees according to the pricing and payment terms presented to you at the time of purchase. All fees are non-refundable unless otherwise stated. Envision reserves the right to modify pricing with 30 days' notice to existing customers.

9.  Disclaimers and Limitation of Liability

10.1 Disclaimers

THE SERVICE AND TEMPLATE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement

  • That the Service will meet your requirements or expectations

  • That the Service will be uninterrupted, timely, secure, or error-free

  • That any results obtained through the Service will be accurate or reliable

  • That any errors in the Service will be corrected

 

10.2 No Employment Advice

Envision does not provide legal, tax, or regulatory advice. The template is a tool for organizing recruiting workflows and does not constitute guidance on employment law, hiring practices, or compliance matters. You should consult with qualified legal counsel regarding employment law compliance.

 

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENVISION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service

  • Any unauthorized access to or use of our servers

  • Any interruption or cessation of transmission to or from the Service

  • Any bugs, viruses, or the like that may be transmitted through the Service by any third party

  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service

 

IN NO EVENT SHALL ENVISION'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Envision Talent Solutions, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of and access to the Service

  • Your violation of these Terms

  • Your violation of any third-party rights, including without limitation any privacy or intellectual property rights

  • Your violation of any applicable law or regulation

  • Any claim that your use of the Service caused damage to a third party

11. Termination

Envision may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may stop using the Service at any time.

 

All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Modifications to the Service

Envision reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. Envision shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.


Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Envision regarding the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Envision's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without Envision's prior written consent. Envision may assign these Terms without restriction.

14.5 Force Majeure

Envision shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, labor disputes, or interruptions in internet service or Google Workspace services.
